Terms of Service — Ayer

Welcome to Ayer. These Terms of Service ("Terms") govern your use of the Ayer application and related services (collectively, "the Service"), provided by Lamin Diallo Solana ("we", "us"). By using Ayer, you agree to these Terms. If you do not agree, please do not use the Service.

1. What Ayer is

Ayer is a personal behavioral-measurement tool. It lets you define your own goals, translate them into measurable behaviors ("metrics"), log your behavior, and see scores and patterns reflecting how your actions align with the standards you set for yourself.

Ayer is a measurement and reflection tool. It is not a medical, psychological, financial, or professional advisory service. Scores, insights, and patterns are informational only. You are responsible for your own decisions.

2. Your account

• You may use Ayer anonymously (data stays on your device) or create an account to sync across devices.
• You are responsible for keeping your login credentials secure.
• You must provide accurate information when creating an account.
• You must be at least 16 years old to use Ayer.

3. Your content and data

• You retain ownership of all content you create in Ayer (goals, metrics, logs, reflections).
• You can export or delete your data at any time using the in-app features.
• Our handling of your data is described in our Privacy Policy.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service
• Use the Service to harm yourself or others
• Misuse the AI-assisted features to generate harmful, illegal, or abusive content

We reserve the right to suspend or terminate accounts that violate these Terms.

5. AI-assisted features

Ayer offers optional AI-assisted features (such as a goal builder and generated insights). These features:

• Use third-party AI providers (see Privacy Policy)
• Produce suggestions and explanations that are informational only and may contain errors
• Should not be relied upon as professional advice of any kind

You are responsible for reviewing and deciding whether to act on any AI-generated content.

6. Free and premium plans

Ayer offers a free tier and may offer paid premium features ("Ayer Insight" or similar).

• Free tier: core measurement, goal creation, logging, history, and basic patterns are available at no cost (subject to any usage limits described in the app, such as limits on AI-assisted goal creation).
• Premium features: advanced features (such as detailed behavioral correlation analysis and AI-narrated insights) may require a paid subscription.

For paid subscriptions (when available):

• Prices, billing cycles (monthly/annual), and any one-time options are shown in the app or on the relevant app store before you purchase.
• Subscriptions may auto-renew unless cancelled; you can manage or cancel through your app-store account or in-app settings.
• Payments may be processed by third-party platforms (such as Google Play or the Apple App Store), subject to their own terms.
• Refunds are handled according to the applicable app-store policy and applicable consumer-protection law. As an EU consumer, you may have statutory rights regarding digital services.
• We may change pricing or features with reasonable notice; changes will not affect a billing period you have already paid for.

7. Availability

We aim to keep Ayer available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue parts of the Service. We are not liable for data loss; please use the export feature to keep your own backups.

8. Disclaimers and limitation of liability

• The Service is provided "as is" without warranties of any kind, to the extent permitted by law.
• Ayer's scores, insights, and patterns are informational; we do not warrant their accuracy or fitness for any particular purpose.
• To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
• Nothing in these Terms limits liability that cannot be limited under applicable law (including mandatory EU consumer-protection rights).

9. Termination

You may stop using Ayer and delete your account at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, your data is handled as described in the Privacy Policy.

10. Governing law

These Terms are governed by the laws of Spain, without prejudice to any mandatory consumer-protection rights you have in your country of residence within the EU.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date, and notify you of significant changes within the app. Continued use after changes means you accept the updated Terms.
